Research into posting of workers in European road transport

On behalf of the Ministry of Social Affairs and Employment and the Netherlands Labour Authority, Panteia conducted an implementation assessment and baseline measurement on the implementation of Directive (EU) 2020/1057 concerning the posting of workers in road transport.

The study shows how the application of the posting rules is experienced in practice and what the consequences are for posted drivers, transport companies and supervisory authorities.

The study shows that the regulations are perceived as complex by the parties involved. In addition, entrepreneurs and, in particular, drivers often have limited knowledge of the applicable rules and rights. The study also identifies practical limitations in supervision and enforcement. Furthermore, points for attention are described in the areas of legislation, information provision and the use of the Internal Market Information System (IMI).

The Minister of Social Affairs and Employment, J.A. Vijlbrief, stated in his letter to Parliament:

“With this implementation assessment, the Netherlands has gathered valuable information for the evaluation that the European Commission will carry out on the basis of Article 7 of the Mobility Directive. I would like to thank Panteia for the extensive research and for providing insight into the main bottlenecks.”

The results of the study have been submitted to the Ministry of Social Affairs and Employment and will be taken into account in the Dutch contribution to the European Commission’s evaluation of the Directive.
